Terms of Service - HABITAT AI

1. Introduction

Welcome to HABITAT AI ("HABITAT", "the App", "we", "us", or "our"). These Terms of Service

("Terms") govern your access to and use of the HABITAT AI mobile application, operated by Logic

Line LLC.

By downloading, installing, or using HABITAT, you agree to be bound by these Terms. If you do

not agree to these Terms, do not use the App.

2. Description of Service

HABITAT is an AI-powered environment wellness application that provides:

- Science-backed analysis of your physical environments using computer vision AI

- Personalized missions to improve your spaces based on 87 peer-reviewed studies

- Environmental Wellness Index (EWI) tracking across 7 environment types

- Cross-environment pattern detection and insights

- Progress tracking with gamification (XP, levels, achievements, streaks)

- Anonymous benchmarking against other users

The App is designed for individual consumers who want to improve their physical living and

working environments for better health and wellbeing.

3. Eligibility

To use HABITAT, you must:

- Be at least 13 years old, or the age of majority in your jurisdiction

- Have the authority to bind yourself to these Terms

- Provide accurate and complete registration information

- Not be prohibited from using the App under applicable laws

4. Account Registration

4.1 Account Creation

To access HABITAT's features, you must create an account by signing in with:

- Apple Sign-In, or

- Google Sign-In

4.2 Account Security

You are responsible for:

- Maintaining the security of your Apple ID or Google account

- All activities that occur under your account

- Notifying us immediately of any unauthorized access

5. Acceptable Use

5.1 You agree to:

- Use HABITAT only for lawful purposes

- Provide photos of your own environments for analysis

- Respect the privacy of others who may appear in photos

- Comply with all applicable laws in your jurisdiction

5.2 You agree NOT to:

- Share your account credentials with unauthorized persons

- Attempt to access accounts or data belonging to others

- Interfere with or disrupt the App's functionality

- Reverse engineer, decompile, or attempt to extract the source code

- Use automated systems or bots to access the App

- Upload malicious code or content

- Misrepresent your identity or affiliation

- Submit photos that do not depict real environments (e.g., AI-generated images, screenshots)

- Use the App to photograph or analyze environments without the consent of their occupants

6. Subscription and Pricing

6.1 Subscription Required

HABITAT requires an active subscription to access the App's features. The subscription provides

full access to:

- Unlimited environment scans and AI analysis

- All 7 environment types (bedroom, kitchen, workspace, living room, bathroom, nutrition,

commute)

- Personalized missions and recommendations

- Progress tracking, achievements, and benchmarking

6.2 Pricing

- Annual subscription billed once per year

- Pricing is displayed in the App and may vary by region

6.3 Payment Terms

- Subscription fees are billed in advance through Apple's App Store

- All payments are processed by Apple — we do not directly handle payment information

- Prices may change with reasonable notice; changes will not affect your current billing period

6.4 Free Trial

If a free trial is offered, it will be clearly indicated in the App. At the end of the trial

period, your subscription will automatically convert to a paid subscription unless cancelled.

6.5 Cancellation and Refunds

- You may cancel your subscription at any time through your Apple ID subscription settings

- Access to the App will continue until the end of your current billing period

- Refunds are handled by Apple in accordance with their refund policy

- No refunds will be provided for partial billing periods

7. Data and Content

7.1 Your Data

You retain ownership of all data you input into HABITAT, including:

- Environment photos

- Scan results and scores

- Mission progress

- Profile information

7.2 License to Us

By using HABITAT, you grant us a limited license to:

- Process your photos through our AI analysis service to provide environment assessments

- Store your scan results and progress data to deliver the Service

- Create anonymized, aggregated data for benchmarking percentile calculations

- Sync your data across your devices via Apple iCloud

7.3 Data Deletion

You may delete your account and all associated data at any time through Settings → Account →

Delete Account. Upon deletion, your data will be permanently removed from our systems within 30

days.

8. AI Analysis and Recommendations

8.1 Nature of AI Analysis

HABITAT uses artificial intelligence (Anthropic's Claude) to analyze photos of your

environments and provide recommendations. You acknowledge that:

- AI analysis is based on pattern recognition and scientific literature, not human expert

review

- Scores and recommendations are approximations and may vary between scans

- The AI may not detect all relevant elements in an environment

- Recommendations are general guidance, not professional advice

8.2 Health Disclaimer

HABITAT provides science-backed recommendations to improve your physical environments. It is

NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. The App is

not HIPAA-compliant. Do not use HABITAT as a substitute for professional medical, health,

ergonomic, or safety advice. Always consult qualified professionals for health-related

decisions.

8.3 Photo Processing

Photos submitted for analysis are:

- Processed on your device to blur any detected faces before transmission

- Sent to our AI provider via encrypted connection for real-time analysis

- Not stored on any server after analysis is complete

- Not used to train any AI models

9. Intellectual Property

9.1 Our Property

HABITAT and its original content, features, functionality, scientific research database,

mission catalog, and scoring algorithms are owned by Logic Line LLC and are protected by

international copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"HABITAT", "HABITAT AI", "Environmental Wellness Index", and the HABITAT logo are trademarks of

Logic Line LLC. You may not use these marks without our prior written consent.

9.3 Feedback

Any feedback, suggestions, or ideas you provide about HABITAT may be used by us without any

obligation to compensate you.

10. Third-Party Services

10.1 Supabase

HABITAT uses Supabase for user authentication and data storage. Your use of HABITAT is also

subject to Supabase's Terms of Service and Privacy Policy.

10.2 Anthropic Claude API

Environment photo analysis is performed by Anthropic's Claude API. Photos are processed in

accordance with Anthropic's data usage policy and are not retained after analysis.

10.3 RevenueCat

Subscription management is handled by RevenueCat. RevenueCat processes purchase receipts from

Apple to validate your subscription status.

10.4 Apple Services

HABITAT integrates with Apple Sign-In, Apple CloudKit (iCloud), and Apple StoreKit (In-App

Purchases). Your use of these services is subject to Apple's Terms and Conditions.

11. Disclaimers

11.1 "As Is" Service

HABITAT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS

OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- MERCHANTABILITY

- FITNESS FOR A PARTICULAR PURPOSE

- NON-INFRINGEMENT

- ACCURACY OR RELIABILITY OF AI ANALYSIS

11.2 No Guarantee

We do not guarantee that:

- The App will be uninterrupted or error-free

- Defects will be corrected

- The App is free of viruses or harmful components

- AI analysis results will be perfectly accurate

- Following recommendations will achieve specific health outcomes

11.3 Environment Decisions

HABITAT provides tools and recommendations to assist with improving your environments. You are

solely responsible for:

- Verifying that recommendations are appropriate for your specific situation

- Ensuring any physical changes to your environment are safe

- Consulting professionals for structural, electrical, or safety-related changes

- Final decisions about your living and working spaces

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOGIC LINE LLC SHALL NOT BE LIABLE FOR:

- Any indirect, incidental, special, consequential, or punitive damages

- Loss of profits, revenue, data, or business opportunities

- Damages arising from your use or inability to use the App

- Any actions taken based on AI recommendations

- Personal injury or property damage resulting from environment modifications

12.2 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF HABITAT SHALL NOT

EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED US

DOLLARS ($100), WHICHEVER IS GREATER.

12.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability.

In such cases, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Logic Line LLC, its officers, directors,

employees, and agents from any claims, damages, losses, liabilities, and expenses (including

legal fees) arising from:

- Your use of HABITAT

- Your violation of these Terms

- Your violation of any rights of another party

- Any photos or data you submit through the App

- Any actions taken based on the App's recommendations

14. Termination

14.1 By You

You may terminate your account at any time by:

- Deleting your account through Settings → Account → Delete Account

- Contacting us at logiclinelabs@gmail.com

14.2 By Us

We may suspend or terminate your access to HABITAT at any time, with or without notice, for:

- Violation of these Terms

- Fraudulent or illegal activity

- Non-payment of subscription fees

- Abuse of the AI analysis service

- Any reason at our sole discretion

14.3 Effect of Termination

Upon termination:

- Your right to use HABITAT immediately ceases

- Your subscription will not be renewed

- We may delete your data after 30 days

- Provisions that by their nature should survive will remain in effect

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes

by:

- Posting the updated Terms in the App

- Updating the "Last Updated" date at the top of these Terms

- Displaying a notice upon login if changes are material

Your continued use of HABITAT after changes constitutes acceptance of the new Terms.

16. Governing Law and Disputes

16.1 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without

regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of HABITAT shall be resolved through:

- Informal Resolution: Contact us first to attempt to resolve the dispute informally

- Binding Arbitration: If informal resolution fails, disputes will be resolved through binding

arbitration in accordance with the rules of the American Arbitration Association

16.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate

in class action lawsuits or class-wide arbitration.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and

Logic Line LLC regarding HABITAT.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will

continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of

those rights.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our

rights and obligations without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our

reasonable control, including natural disasters, war, terrorism, strikes, or internet outages.
